Welcome to KREWSR. These Terms & Conditions (“Terms”) govern your access to and use of www.krewsr.com and the KREWSR mobile apps (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. Hosts also agree to the Host Payment Terms in section 6.

1. About KREWSR

KREWSR is a Jamaican vehicle rental service that offers cars supplied by independent vehicle owners (“Hosts”) to customers (“Renters”). KREWSR operates the booking platform, sells the rental to the Renter, collects payment, provides customer support, and pays Hosts for supplying their vehicles. KREWSR does not own the vehicles listed by Hosts, except where expressly stated.

2. Eligibility

You must be at least 18 years old and legally able to enter a binding contract.
Renters must hold a valid driver’s licence and meet any requirements stated on the listing.
Hosts must own the vehicle or be authorised by the owner to rent it out, and the vehicle must be lawfully registered, insured and fit for use on Jamaican roads.
You must verify your email address before using your account, and you agree to provide accurate information and keep your account secure.

3. Accounts

You are responsible for all activity under your account. Notify us immediately of unauthorised use at admin@krewsr.com. We may suspend or terminate accounts that violate these Terms or create safety, fraud, or legal risk.

4. Listings and bookings

Hosts are responsible for the accuracy of listing details, availability, daily rate, and vehicle condition.
A booking is confirmed when the Host accepts it (or instantly, for Instant Book listings) and the Renter’s payment to KREWSR is completed.
The Renter’s contract for payment is with KREWSR. Use of the vehicle is also subject to any rules the Host states on the listing.
Pickup, delivery, and handover rules are described in our Delivery / Pickup Policy.

5. Prices and payment (Renters)

Prices are shown in Jamaican dollars (JMD) unless otherwise stated. The total shown at checkout is the full amount you pay for the booking.
You pay KREWSR directly through our secure checkout. Card payments are processed by our licensed payment providers; KREWSR does not store full card numbers.
Cash at pickup. Where a Host’s listing shows “Cash accepted”, you may choose to pay the booking total in Jamaican dollars directly to the Host when you collect the vehicle. Pay only the amount shown on your booking and ask the Host to mark the payment received in KREWSR. You may switch to online payment at any time before pickup.
Payment to KREWSR, or a cash payment to the Host for a cash booking, fully settles your rental charge. You must not pay the Host any additional amount for a booking made on KREWSR, and the Host must not ask you to.
Charges will appear on your statement from KREWSR or our payment provider.

6. Host Payment Terms

Collection. KREWSR collects the full booking payment from the Renter into KREWSR’s business bank account. Hosts may not collect payment for KREWSR bookings outside the Service, except cash bookings described below.
Cash bookings. You may opt in to accept cash on a listing. For a cash booking you collect the booking total from the Renter at pickup or delivery and must mark the cash as received in KREWSR the same day. The KREWSR service fee for that booking is then recorded on your Earnings ledger and deducted from your next payout. If you have no earnings to deduct it from, KREWSR may ask you to pay the fee by bank transfer, and may disable cash on your listings if fees remain unpaid. You are responsible for the safekeeping of cash you collect.
Your earnings. For each paid booking, you earn the booking total less the KREWSR service fee (currently 15% of the booking total). Your earnings are recorded in your Earnings ledger as soon as the Renter’s payment is completed.
No wallet or stored value. Your earnings balance is an accounting record of the amount KREWSR owes you. It is not a deposit, wallet, or stored-value account, does not earn interest, and cannot be used to make payments.
Payout cycle. KREWSR pays Hosts by bank transfer on a regular payout cycle (currently weekly). The schedule may change with notice on your Earnings page. Balances below a minimum payout amount, if one applies, roll over to the next cycle.
Bank details. You must provide accurate bank account details in your name or your business’s name. KREWSR is not responsible for delays or losses caused by incorrect details you provide. Payouts are held until valid bank details are on file.
Refunds and adjustments. If a Renter is refunded under our Refund Policy, your earnings for that booking are reduced proportionally. KREWSR may also record adjustments for chargebacks, damage settlements, fines, or errors. If your balance becomes negative, it is deducted from future earnings or you may be asked to repay it.
Statements. Each payout lists the bookings and adjustments it covers and the bank transfer reference. You can download your full statement at any time.
Taxes. Hosts are responsible for declaring their rental income and for their own tax obligations. KREWSR may request your Taxpayer Registration Number (TRN) and may report payments to the authorities where required by law.

7. Cancellations and refunds

Cancellations and refunds are governed by our Refund / Return Policy. Approved refunds are issued by KREWSR to the original payment method. Refunds of cash paid to a Host are made by the Host, as described in the Refund Policy.

8. User conduct

You agree not to:

Violate Jamaican or other applicable law
Post false, misleading, or infringing content
Harass, threaten, or discriminate against other users
Arrange or accept payment for KREWSR bookings outside the Service, or otherwise circumvent fees or safety features
Use the Service for unauthorised commercial scraping or attacks

9. Vehicle use and liability

Renters must operate vehicles lawfully, on the left-hand side of the road in Jamaica, and only as permitted by the Host and their licence class.
Renters are responsible for traffic offences, fuel, and damage caused during the rental period, as stated on the listing and as required by law.
Hosts are responsible for keeping the vehicle roadworthy, registered, and insured for rental use.
To the extent permitted by law, KREWSR is not liable for losses arising from vehicle condition, accidents, or theft that are not caused by KREWSR.

10. Content licence

You grant KREWSR a non-exclusive licence to host and display content you upload (such as listing photos) for operating and promoting the Service. You represent that you have rights to that content.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of liability

To the maximum extent permitted by law, KREWSR’s total liability for any claim related to the Service is limited to the greater of (a) the amount you paid to KREWSR for the booking giving rise to the claim, or (b) JMD $10,000. We are not liable for indirect, incidental, or consequential damages.

13. Indemnity

You agree to indemnify and hold harmless KREWSR from claims arising out of your use of the Service, your listings or bookings, or your breach of these Terms.

14. Changes

We may update these Terms by posting a revised version on this page. Material changes to the Host Payment Terms will be notified to Hosts by email or on their Earnings page. Continued use after changes constitutes acceptance.

15. Governing law

These Terms are governed by the laws of Jamaica. Courts in Jamaica have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
